What is a Will and why do you need one? A Will is simply a document which tells your loved ones how your property should be distributed upon your death. If you die without a Will, the government assumes control and dictates how your property should be distributed. With a Will, you maintain the power to determine who will be the guardian for your children, and exactly how your estate will be disbursed among your loved ones. If your Will is more than 10 years old, the supporting Affidavits of Execution, will not have been produced, nor will there be Powers of Attorney. Without these documents your Wills will be substantially more expensive to Probate upon death and without Powers of Attorney upon illness your financial affairs will be compromised as well as your health care. On the breakdown of a common-law relationship property disputes are effectively decided on the basis of unjust enrichment. One party may make a claim that they are enriched by the other through work or contribution of monies. Accordingly, one party is claiming that they suffered a deprivation while the other party enjoyed the benefit.  Further, there must be no juristic reason that the other party should retain the benefit.

This office has almost 40 years of experience in this area and can provide the right advice and direction to make certain that the benefits of the Supreme Court of Canada's redefined definition of this area of law are applied to your case.

Certainly this office counsels the benefits of cohabitation agreements which if signed at the beginning of the relationship, define the resolution, should the relationship end, without the expense and uncertainty of litigation.
